Mandatory prior claim before filing a lawsuit

In April 2025, Organic Law 1/2025 on measures for the efficiency of the Public Justice Service came into force. This legislation established the obligation to attempt a solution outside the courts before filing a lawsuit in the vast majority of civil proceedings.

If you are owed, for example, €6,000 for work carried out or for money lent, before filing a lawsuit it will be necessary to attempt an out-of-court solution. If you do not, the subsequent lawsuit will be ruled inadmissible.

What is a burofax or buromail?

Burofax

A certified postal service with legal value that records the date of dispatch and the content of the document. You only need the recipient's name and postal address.

Buromail

The electronic version of the Burofax with legal validity and immediate notification. Sent by email or mobile phone. More convenient when no postal address is available.

What form must the claim take?

For the claim to be valid it must take the form of a Confidential Binding Offer (OVC). Any ordinary burofax will not be sufficient to meet the requirement of having attempted an out-of-court solution prior to a lawsuit.

The OVC is confidential. It must record the identity of the offeror, its receipt, the date on which it occurs, and its content.

The recipient has 30 calendar days to accept, reject or not reply. If they do not expressly accept, it will be deemed rejected, which means the procedural requirement for filing the lawsuit is considered met.
